Terms and Conditions

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the Stars N Celebs platform available at starsncelebs.in (the "Platform"), operated by Stars N Celebs, Mumbai, India ("we", "us", "our").

By registering, subscribing, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you are registering on behalf of a minor, you confirm that you are the minor's parent or legal guardian and that you accept these Terms on the minor's behalf.

If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

  • You must be at least 18 years of age to register independently. Users under 18 may use the Platform only with verifiable parental or guardian consent.
  • You must provide accurate, complete, and current registration information.
  • You must not have been previously suspended or removed from the Platform.
  • By registering as a Brand, you confirm you are acting on behalf of a legitimate business or organization.

3. Account Registration and Security

To access the Platform's features, you must create an account by providing your name, email address, phone number, and other required details, and by selecting a unique username that becomes your personalized URL (starsncelebs.in/YourName).

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
  • We reserve the right to refuse, reclaim, or reassign usernames that violate these Terms or infringe third-party rights.

4. Platform Services

4.1 What Stars N Celebs Provides

  • A personalized, publicly accessible artist profile page at starsncelebs.in/YourName
  • Built-in SEO optimization to help your profile appear in Google search results
  • An Opportunity Board where artists can discover and apply for projects
  • Tools to showcase your portfolio, social media links, and contact information
  • Zero commission on any bookings or earnings facilitated through the Platform

4.2 What Stars N Celebs Does Not Provide

  • Stars N Celebs is a discovery and identity platform, not a talent agency or booking agent.
  • We do not guarantee bookings, job offers, auditions, or any specific outcome from using the Platform.
  • We do not verify the identity or credentials of brands, scouts, or other users who contact artists through the Platform.
  • We are not a party to any contract, agreement, or transaction between an artist and a brand or third party.

5. Subscriptions and Payments

5.1 Subscription Plans

Access to the Platform's full features requires a paid subscription. Current plans are:

  • Talent Plan: Rs. 450 per 90 days
  • Featured Artist Plan: Rs. 2,000 per 90 days

Plan features, pricing, and duration are as described on the Subscriptions page at starsncelebs.in/subscriptions and are subject to change with notice.

5.2 Payment Processing

All payments are processed securely through Razorpay. Accepted payment methods include credit/debit cards, UPI, and net banking. By completing a payment, you authorize Stars N Celebs to charge the applicable subscription fee.

5.3 Refund Policy

All subscription fees are non-refundable. Once a payment has been successfully processed, no refund will be issued under any circumstances, including but not limited to change of mind, non-use of the Platform, or dissatisfaction with the service. We encourage you to review all plan details carefully before subscribing.

5.4 Subscription Renewal

Subscriptions do not auto-renew. You must manually renew your subscription before the expiry date to maintain access to paid features. Upon expiry, your profile will remain visible on the Platform but paid features may be restricted.

6. User Content

6.1 Your Responsibility

You are solely responsible for all content you upload, post, or display on your profile, including photos, videos, bios, and links ("User Content"). By uploading User Content, you confirm that:

  • You own the content or have the necessary rights and permissions to use and share it
  • The content does not infringe any third-party intellectual property rights
  • The content does not violate any applicable law or regulation
  • The content is accurate and not misleading

6.2 Licence to Stars N Celebs

By uploading User Content to the Platform, you grant Stars N Celebs a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your content on the Platform and in promotional materials such as social media posts or marketing campaigns for the purpose of operating and promoting the Platform. We will credit you where applicable. You may withdraw this licence by deleting your content or account.

6.3 Prohibited Content

You must not upload or share content that:

  • Is pornographic, obscene, or sexually explicit
  • Contains hate speech, discrimination, or material targeting individuals on the basis of race, religion, gender, or any other protected characteristic
  • Promotes violence, self-harm, or illegal activity
  • Exploits or depicts minors in any harmful or inappropriate manner
  • Is defamatory, abusive, or harassing toward any individual or group
  • Infringes any third-party copyright, trademark, or other intellectual property right
  • Contains religious messaging, political content, or socially divisive material
  • Is spam, misleading, or fraudulent
  • Contains malware, viruses, or any harmful code

Stars N Celebs reserves the right to remove any content that violates these Terms without prior notice and without liability.

7. Opportunity Board

The Opportunity Board allows users to post and discover project opportunities. Stars N Celebs does not vet, endorse, or guarantee any opportunity listed on the Platform. Artists engage with opportunities entirely at their own risk. We strongly advise users to independently verify the legitimacy of any brand, scout, or organizer before entering into any agreement or attending any audition or event.

Stars N Celebs is not responsible for any loss, harm, or dispute arising from interactions between artists and brands facilitated through the Platform.

8. Acceptable Use

You agree not to use the Platform to:

  • Impersonate any person, artist, brand, or organization
  • Scrape, harvest, or collect data from the Platform using automated tools
  • Attempt to gain unauthorized access to any part of the Platform or another user's account
  • Interfere with or disrupt the Platform's servers, networks, or security
  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Engage in any conduct that could damage the reputation of Stars N Celebs or harm other users

9. Intellectual Property

All content on the Platform that is not User Content, including the Stars N Celebs name, logo, design, software, copy, and structure, is the exclusive intellectual property of Stars N Celebs and is protected under applicable Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

10. Account Suspension and Termination

10.1 Termination by You

You may delete your account at any time by contacting [email protected]. Upon deletion, your profile will be removed from the Platform. No refund of any unused subscription period will be issued.

10.2 Termination by Stars N Celebs

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if:

  • You breach any provision of these Terms
  • You engage in conduct that we determine, in our sole discretion, to be harmful to other users, third parties, or the Platform
  • You provide false or misleading information during registration
  • We are required to do so by applicable law or a competent authority

Upon termination, your right to access and use the Platform ceases immediately. No refund will be issued for any remaining subscription period.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Stars N Celebs shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • Any loss of earnings, bookings, opportunities, reputation, or data
  • Any harm arising from interactions between artists and brands or third parties facilitated through the Platform
  • Any technical failures, service interruptions, or data loss

Our total liability to you for any claim arising under these Terms shall not exceed the subscription fee paid by you in the three months immediately preceding the event giving rise to the claim.

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless Stars N Celebs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document. Where changes are material, we will notify registered users by email at least 7 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Before initiating any legal proceedings, you agree to first contact us at [email protected] and allow us 30 days to attempt to resolve the dispute informally.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stars N Celebs with respect to your use of the Platform and supersede all prior agreements, understandings, and representations.
